Welcome to A1 Med. These Terms and Conditions (“Terms”) govern your access to and use of the A1 Med website, including a1med.us, and any services, products, forms, ordering tools, or other features made available through the website (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site.

A1 Med reserves the right to modify these Terms at any time. Changes become effective when posted to the Site unless otherwise stated. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

1. Description of Services

A1 Med provides access to information and services relating to medical supplies and related products, including, but not limited to, diabetes supplies, continuous glucose monitoring supplies, CPAP and sleep-apnea supplies, catheter and ostomy supplies, incontinence supplies, compression garments, enteral nutrition products, and other medical supplies.

The availability of specific products and services may vary based on product availability, medical necessity, applicable laws and regulations, insurance coverage, supplier requirements, and other factors.

Information presented on the Site is provided for general informational purposes and is not intended to replace advice, diagnosis, or treatment from a qualified healthcare professional.

A1 Med reserves the right to modify, suspend, or discontinue any portion of the Site or its services at any time, with or without notice.

2. Eligibility and Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms.

A1 Med does not provide emergency medical services through the Site.

5. Orders, Products, and Availability

A1 Med reserves the right to limit quantities, discontinue products, correct errors in product descriptions or pricing, and refuse or cancel orders when appropriate.

Submitting an order, request, reorder form, or other inquiry through the Site does not necessarily constitute acceptance of the order. An order may be subject to verification, insurance requirements, medical documentation, prescription requirements, product availability, eligibility requirements, and other applicable conditions.

A1 Med reserves the right to refuse or cancel an order or request when necessary, including when information provided is inaccurate or incomplete or when the requested product or service cannot be provided.

6. Insurance and Payment

Certain products and services offered by A1 Med may be eligible for coverage through Medicare, Medicaid, private insurance, or other benefit programs.

Coverage is determined by the applicable insurance plan, program requirements, medical necessity criteria, documentation requirements, and other applicable rules. Submission of an order or insurance information does not guarantee coverage or payment by an insurance provider.

You may be responsible for applicable deductibles, coinsurance, copayments, non-covered items, or other amounts not paid by your insurance provider.

A1 Med may request additional information or documentation when necessary to process an order or insurance claim.

7. Shipping and Delivery

A1 Med will make reasonable efforts to process and ship orders within the applicable timeframe. Shipping and delivery dates are estimates and may be affected by product availability, insurance processing, weather, carrier delays, governmental requirements, or other circumstances beyond A1 Med’s reasonable control.

A1 Med is not responsible for delays caused by third-party shipping carriers or circumstances beyond our reasonable control.

8. Returns, Exchanges, and Product Warranties

Returns, exchanges, refunds, and warranty claims are subject to A1 Med’s applicable policies and, where applicable, the manufacturer’s warranty and return requirements.

Certain medical supplies may be subject to restrictions on returns or exchanges because of health, safety, regulatory, or infection-control requirements.

Where a product is covered by a manufacturer’s warranty, the manufacturer’s warranty terms may apply. A1 Med may assist customers with warranty-related matters when appropriate, but A1 Med does not provide warranties beyond those expressly stated or required by applicable law.

9. Intellectual Property

All content on the Site, including text, graphics, photographs, illustrations, logos, icons, designs, videos, documents, software, and other materials, is owned by or licensed to A1 Med or its respective owners and is protected by applicable intellectual property laws.

You may access and use Site content for your personal, non-commercial use and for the purpose of using A1 Med’s services.

You may not reproduce, modify, distribute, publish, transmit, display, create derivative works from, sell, or commercially exploit Site content without prior written permission from A1 Med or the applicable rights holder.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT, SERVICES, AND FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

A1 MED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT THAT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

A1 Med does not warrant that:

• The Site will always be available or uninterrupted;
• The Site will be free of errors, defects, viruses, or other harmful components;
• Information on the Site will always be complete, accurate, or current;
• Products or services will always be available; or
• The Site will meet every user’s particular requirements.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A1 MED AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES.

THIS LIMITATION INCLUDES, TO THE EXTENT PERMITTED BY LAW, DAMAGES RESULTING FROM LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR OTHER ECONOMIC LOSS.

NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless A1 Med and its owners, affiliates, officers, directors, employees, agents, contractors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• Your violation of these Terms;
• Your misuse of the Site;
• Your violation of applicable law or the rights of another person; or
• Information or materials you submit through the Site.

15. Security

You agree not to attempt to compromise the security of the Site or any systems connected to it.

This includes attempting to gain unauthorized access to accounts, servers, networks, databases, or other systems; introducing malicious software; or interfering with the operation of the Site.

A1 Med reserves the right to cooperate with law enforcement and other appropriate authorities regarding suspected violations of applicable law or security requirements.

16. Promotions and Third-Party Advertising

The Site may occasionally contain information about promotions, offers, products, or services provided by A1 Med or third parties.

Any third-party promotion, product, or service is subject to the terms and conditions established by the applicable provider. A1 Med is not responsible for the content or performance of third-party promotions or services. Carriers are not liable for any delayed or undelivered messages.

17. Privacy

Your use of the Site is also governed by the A1 Med Privacy Policy.

Our Privacy Policy explains how information collected through the Site may be collected, used, disclosed, and protected.

By using the Site, you acknowledge that you have reviewed the Privacy Policy.

18. Termination

A1 Med may suspend or terminate your access to all or part of the Site at any time, with or without notice, if we believe you have violated these Terms, applicable law, or for other legitimate business or security reasons.

Upon termination, provisions of these Terms that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

19. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Mississippi, without regard to its conflict-of-law principles, except where federal law applies.

Any dispute arising from or relating to these Terms or your use of the Site shall be subject to the jurisdiction of the applicable state or federal courts located in Mississippi, unless otherwise required by applicable law.

20. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

A1 Med’s failure to enforce any provision of these Terms does not constitute a waiver of that provision or of our right to enforce it in the future.

These Terms, together with the A1 Med Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement between you and A1 Med regarding your use of the Site and supersede prior agreements or understandings relating to the Site, except where a separate written agreement expressly applies.

23. Changes to These Terms

A1 Med may update or modify these Terms from time to time.

When changes are made, the updated Terms will be posted on this page with a revised effective date. Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the revised Terms to the extent permitted by law.

Messages may include order confirmations and shipping/delivery updates; reminders when a recurring supply (diabetic, CPAP, catheter, ostomy, or similar) is due for reorder; appointment, insurance, and account notifications; responses to customer support requests; and occasional promotional offers.
