1. Who We Are

A1 Med is a durable medical equipment (DME) supplier accredited by the Accreditation Commission for Health Care (ACHC), providing diabetic supplies, continuous glucose monitors, insulin pumps, CPAP supplies, catheter supplies, and ostomy supplies, along with insurance verification and billing support for Medicare and commercial insurance plans.

• Insurance and billing information: Medicare number or other insurance identification numbers, group or plan numbers, and payment information for amounts not covered by insurance.
• Account information: Login credentials and order history if you create an account for reorders, bill pay, or other services.
• Forms you submit: Information entered into our eligibility checker, provider referral form, patient referral form, contact forms, or other forms available through the Site.
• Communications: Records of calls, emails, messages, or other communications you exchange with our customer service team.

Information We Receive From Others

We may receive information about you from third parties, including:

• Referring physicians, clinics, or caregivers who submit information on your behalf;
• Your insurance carrier or payer, including Medicare, when we verify eligibility or process claims; and
• Shipping and delivery partners regarding delivery status.

When you visit the Site, we and our service providers may automatically collect certain device and usage information, such as your IP address, browser type, pages viewed, referring URLs, and information about how you interact with the Site.

3. How We Use Your Information

• Verify insurance eligibility and coverage and submit and manage claims with Medicare and commercial insurance payers;

• Bill you for amounts not covered by insurance and process payments;
• Create and manage your account;
• Process reorders;
• Respond to customer service inquiries and requests;
• Communicate with you regarding your orders, supply reorder schedule, account, insurance, billing, or other requested services;
• Send service updates and, where permitted and where you have not opted out, marketing communications about our products and services;
• Maintain the security, integrity, and functionality of the Site;

• Comply with applicable legal, regulatory, accreditation, and governmental requirements, including requirements relating to Medicare, HIPAA, and applicable FDA requirements; and

4. HIPAA and Health Information

To the extent A1 Med creates, receives, maintains, or transmits protected health information (“PHI”) in connection with providing durable medical equipment or billing insurance, we handle that information consistent with the Health Insurance Portability and Accountability Act (“HIPAA”) and applicable state law.

This may include using and disclosing PHI for purposes such as:

• Treatment coordination;
• Payment and insurance billing;
• Healthcare operations;
• Obtaining or confirming documentation required to provide equipment or supplies;

Business Transfers

If A1 Med is involved in a merger, acquisition, financing, reorganization, sale of assets, or other business transaction, information may be transferred as part of that transaction, subject to applicable legal requirements.

We may disclose information to other individuals or entities when you authorize or direct us to do so or when otherwise permitted by applicable law.

7. Data Retention

We retain personal information and protected health information for only as long as reasonably necessary to provide our Services, process and service orders and reorders, administer accounts, process insurance claims and payments, resolve disputes, enforce our agreements, and comply with applicable legal, regulatory, accreditation, Medicare, Medicaid, and other governmental requirements.

Different types of information may be retained for different periods depending on the purpose for which the information was collected and the requirements applicable to that information.

For Medicare DMEPOS-related documentation, including applicable orders, certifications, claims documentation, refill documentation, and proof-of-delivery records, we generally retain the required documentation for at least seven (7) years from the date of service, as required by applicable Medicare requirements.

Certain medical and patient records may be retained for ten (10) years or longer, where required by applicable Mississippi law or other applicable state or federal requirements.

Certain HIPAA-required policies, procedures, and documentation are retained for six (6) years from the date they were created or the date they were last in effect, whichever is later, as required by HIPAA. This six-year requirement does not itself establish a six-year retention period for patients’ medical records.

We may retain information for a longer period when necessary to comply with a legal obligation, respond to an audit or investigation, resolve a dispute, establish or defend legal claims, prevent fraud or abuse, or otherwise comply with applicable law.

When information is no longer required to be retained, we will dispose of or de-identify it in accordance with applicable law and our information-security and records-management procedures.

We use administrative, technical, and physical safeguards designed to protect personal and health information from unauthorized access, use, disclosure, alteration, or destruction.

However, no method of transmitting or storing information is completely secure. We cannot guarantee the absolute security of information transmitted to or stored by us.

We may be required or permitted to retain certain information to provide our Services, complete transactions, process insurance claims, comply with Medicare and other regulatory requirements, maintain required medical or business records, prevent fraud, resolve disputes, establish or defend legal claims, or comply with other legal obligations.

As a result, a request to delete personal information does not necessarily mean that all information associated with you can be deleted.

Certain state consumer privacy laws exempt PHI and other information regulated by HIPAA or other applicable healthcare privacy laws. However, personal information collected through our website that does not constitute PHI may still be subject to applicable state privacy laws.

If applicable California law requires A1 Med to provide an opt-out mechanism for the sale or sharing of personal information or targeted advertising, we will provide the required mechanism.

Certain information, including PHI and records that A1 Med is legally required to retain, may be subject to different access, correction, deletion, or disclosure requirements under HIPAA, Medicare requirements, state law, or other applicable regulations.

10. Children’s Privacy

The Site and Services are intended for adults 18 years of age and older and are not directed to children.

We do not knowingly collect personal information from children under 13 through the Site.
